These Terms of Service apply to the website nightfieldaudio.com and to the digital software product Noctra.

By using this website or purchasing Noctra, you agree to these terms.

1. Seller and merchant of record

Noctra is sold through FastSpring, which acts as the merchant of record for orders, payments, tax calculation, invoicing and payment processing.

Nightfield Audio provides the software product, product information and customer support.

2. Product

Noctra is a downloadable audio plugin for music production.

Current format:
- Windows VST3 only

Not currently supported:
- macOS
- AU
- AAX

Please check the system requirements before purchasing.

3. License

When you purchase Noctra, you receive a personal license to install and use the software for music production and sound design.

You may use sounds processed with Noctra in commercial and non-commercial music, beats, sample packs, client work, videos and other creative projects.

You may not:
- Resell, share, rent, sublicense or redistribute the Noctra plugin file
- Upload the Noctra plugin file to file-sharing websites
- Claim ownership of the software
- Reverse engineer, modify, crack or attempt to bypass any technical protection
- Sell Noctra as part of another software product

4. Delivery

Noctra is delivered as a digital download after purchase through FastSpring. No physical product is shipped.

5. Refunds

Refund requests are handled according to our Refund Policy.

6. Support

Support is available by email at support@nightfieldaudio.com.

When contacting support, include your order email, FastSpring order ID, operating system, DAW, Noctra version and a clear description of the issue.

7. Compatibility

It is your responsibility to make sure your system supports Windows VST3 plugins before purchasing.

Nightfield Audio is not responsible for incompatibility with unsupported systems, unsupported plugin formats or outdated DAW versions.

8. Updates

We may release updates, bug fixes or improvements to Noctra. We are not required to provide updates forever or to support every future operating system, DAW version or plugin format.

9. Intellectual property

Noctra, the Noctra name, product design, graphics, audio processing, website content and related materials are owned by Nightfield Audio unless otherwise stated.

10. Limitation of liability

Noctra is provided as digital software for creative use. To the maximum extent permitted by law, Nightfield Audio is not liable for indirect damages, lost profits, lost projects, loss of data or any damage caused by misuse, unsupported systems or third-party software conflicts.

11. Changes to these terms

We may update these Terms of Service from time to time. The latest version will be available on this website.
